Terms and Conditions for EnsembleSheetMusic.com

These terms and conditions form the basis on which you can visit us and our website. Please read them carefully as they contain important information.

Introduction

This agreement covers general use of EnsembleSheetMusic.com, including viewing, purchasing and printing content.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.  

1. Ownership of rights & License for performance and recordings

All rights, including copyright, in this website are owned by or licensed to EnsembleSheetMusic. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

When you purchase content from  EnsembleSheetMusic, you are purchasing a licence to download the content in PDF format which you can keep indefinately for your own personal, non commercial use. The content can be printed using your computer and printer, or transferred to a portable device for digital use. You are purchasing a digital downloadable product not a physical copy of the content.

You are not purchasing the copyright to the content. The copyright to the entire content remains with the copyright holder.

You must not copy the content other than for your own personal use. You must not make the content available in any way to any third party without the permission of the copyright holder.

All sheet music purchased from EnsembleSheetMusic.com is license free to be performed and / or recorded.

2. Damage to your computer

We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites or software accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

3. Ordering errors

You are able to correct errors on your order up to the point on which you submit your payment details during the ordering process.

4. Price

The prices payable for goods that you order are as set out in our website. All prices are inclusive of applicable VAT unless otherwise specified, at the current rates and are correct at the time of entering information.

5. Delivery

  1. Delivery will be digital. No physical items will be sent by us to you.
  2. Once you have purchased a product, you will be able to print the content using your own computer and printer. To do this you will need to be able to print PDF files using standard software such as Adobe Reader.
  3. There is no limit to the amount of times you can print the content that you have purchased however you are reminded that you must not make the content available in any way to any third party without the permission of the copyright holder.

6. Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address as shown at the top of this page and all notices from us to you will be displayed on our website from time to time.

7. Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

9. Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with Dutch law.

10. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

11. Third party rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
